The purpose of this Privacy Notice is to inform you of the data relating to you that we may collect and use during the course of our relationship with you and the uses we may make of such data.
The Wedding Wizard ("We", "Us") fully complies with data protection law, including the General Data Protection Regulation, in force and with the confidentiality commitments typical of its activity.
We reserve the right to modify this Privacy Notice at any time. Any changes to this Privacy Notice will be posted on this website so you are always aware of what information we collect, how we use it, and under what circumstances if any, we disclose it. If at any time we decide to use personal data in a manner significantly different from that stated in this Privacy Notice or otherwise disclosed to you at the time it was collected, we will notify you by email, and you will have a choice as to whether or not we use your information in the new manner.
Any definitions stated in this Privacy Notice will have the same meaning as our Term of Use unless stated otherwise.
The Users guarantee that the personal data provided to The Wedding Wizard is truthful and updated, and they are responsible for notifying any changes thereto, where the Users are the only parties responsible for providing inaccurate or false data and for the harm that this may cause to The Wedding Wizard or to third parties as a result of using the service(s) provided by The Wedding Wizard. Likewise, The Wedding Wizard states that the data that it collects are adequate, pertinent and not excessive in relation to its specific scope, purposes and service(s).
The Wedding Wizard Ltd with an address at Chapel Cross, Glenbeigh, Co. Kerry and email address firstname.lastname@example.org is the Controller of your personal data.
2. Data Processor
The Wedding Wizard shall act as the Data Processor in the following services and any others that may arise in the future:
Guestlist, including personal data of the Users' guests who are using guest related services;
Data related to the User’s spouse, until such time as they become a User themselves;
Users’ personal data used by Suppliers while they use The Wedding Wizard tools.
The Controller of the data provided in relation to those services provided by The Wedding Wizard shall be the actual User, who must comply with the data protection regulations, must have obtained consent from the data subjects for processing their personal data and must have applied all the guarantees required for processing their personal data.
The User shall be responsible at all times for the images (and other media) published and the names included. Notwithstanding the foregoing, The Wedding Wizard has the power to remove the content if it is illegal.
The Wedding Wizard shall handle the data according to the standard contractual clauses set forth by the European Commission.
3. External links
This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We are not responsible for the privacy practices or the content of any other websites to which the Services link or which link to our Services. The privacy policies of these other sites will govern the collection and use of your information thereon, and we encourage you to read each such policy to learn about how your information may be treated by others.
When you choose to subscribe to our email list, set up an account or send an enquiry on our Website you consent to the use of that information as set out in this Privacy Notice.
The Wedding Wizard receives your personal data when you set up a profile on our platform. Users including suppliers who have access to this platform will be able to view certain applicable details you input about your wedding,, for example, your name, number of guests, wedding date etc. If you submit information on the Ratings and Reviews tab, this information will be shared publicly.
5. Collection and Use of Personal Data
Personal data is generally information that can reasonably be used to identify or contact you. When you use our Services, we may collect and store personal data about you to provide our Services to you and improve the Services we provide to all of our users.
Personal data we collect includes:
5.1 Information You Provide Directly
Registration and Account Information: When you register an account, we collect certain personal data such as your first name, last name, date of birth and email address, in some instances your address and phone number, photos, wedding data (such as wedding date, engagement date, wedding budget, fiancé name, wedding role, wedding location, supplier bookings), and guest data (such as their name, address, phone number, physical address, email address and photos should they choose to share them). If you share personal data of others, such as your fiancé or partner or guests, with us, you are representing that you are authorised to provide us with their information and that we may treat it in accordance with this Privacy Notice.
As a Supplier, we may also collect business data (such as your activity and business information).
We do not collect Sensitive Data, which includes details about race or ethnicity, religious beliefs and or philosophical beliefs, sexual orientation, information about health and genetic and biometric data. Where you provide us with personal data belonging to another person (including sensitive data), we do not control that personal data and will act only as processor of that personal data in accordance with our obligations contained in our terms and conditions.
In some instances, we offer referral features that allow you to easily connect your profiles with those of your friends and family via email. You can also send your friends and family emails or other messages using our Services. If you choose to use either feature, we may use your email address to copy you on the message or to send on the email on your behalf, and you hereby grant permission for such use.
Customer Services: When you contact us through any of our customer support channels, we collect personal data to track and respond to your enquiry and analyse and improve our Service(s).
Payment Information: If you choose to purchase any goods, services, or premium functionality through our Service(s) or indeed use any of our payment features (such as payments to Suppliers and Cash Gifting as illustrated in Clause 10 of our Terms), you may need to provide your payment information and other personal data, such as your name, address, email address, and telephone number.
Community Features: We may collect personal data when you participate in the social features on the Service(s), including, but not limited to, our review system and blog, our messages feature, forums, or other social features on our websites (collectively “Public Postings”). Whenever you post something publicly, it may be impossible to remove all instances of the posted information, for example, if someone has taken a screenshot of your posting. Please exercise caution before choosing to share personal data publicly on our Public Postings or in any other posting. We do not have any obligation of privacy and you should not have any expectation of privacy with regard to information that you disclose on the Public Postings.
Communications to Suppliers: We may collect personal data when a Member contacts a Supplier through private messaging on our Service(s). For security purposes, Users should not include any password, payment card or other sensitive information via this Service.
Third-Party Service (e.g. Social Media): If you use a third-party site, such as Facebook, Instagram, Snapchat, or Twitter, in connection with our Service(s) to communicate with another person (e.g., to make or post referrals or to request that we communicate with another person), then in addition to that person's name and contact information, we may also collect other information (e.g., your profile picture, network, username, user ID, age range, language, country, friends lists or followers) depending on your privacy settings on the third-party site as permitted by such sites. We do not control the third-party site's information practices, so please review the third party’s privacy policies and your settings on the third party’s site carefully.
Online surveys: From time to time, we may conduct surveys to collect information about user preferences. These are optional, and if you choose to respond, your responses will be treated in accordance with the survey terms, if any, as well as this Privacy Notice and any other applicable policies or terms. These surveys may be conducted by and processed through third parties.
Competitions: We may offer competitions to qualifying users where we request contact and demographic information such as name, email address and physical address. Information we gather through a contest may also be disclosed to third parties as necessary for prize fulfilment and other aspects of any contest or similar offering. Additionally, if we run a co-branded contest or survey with a partner unless the survey or contest terms provide otherwise, information that you provide pursuant to that contest or survey may be provided to that partner, after which it will be subject to that partner’s privacy notice.
5.2 Information Collected from Third Parties
We may supplement personal data you provide us with additional information obtained from publicly available sources, or from our affiliates and third parties with which we transact business.
We also maintain a presence on several social networking and blogging platforms, such as Facebook, Instagram, Twitter, etc.. We may incorporate some third-party social networking features into our Service(s) or utilise third-party provided platforms to publish or manage the Service(s) or portions thereof. Through these platforms and features, we receive some personal data about you, and this Privacy Notice applies to our collection of that information. In addition, some providers of third-party social networking or blogging platforms we utilise (such as Facebook, Instagram, Twitter and Google) have their own privacy policies which explain how the third parties that provide them may collect, use and protect your information on their platforms.
5.3 Information Collected During Use of Service(s)
Geolocation: e.g., town, county, country, and EIRCODE associated with your IP address or derived through Wi-Fi triangulation; and, with your permission in accordance with your mobile device settings, and precise geolocation information from GPS-based functionality on your mobile devices.
Browser and Device Information: As is the case with many websites, our Service(s) automatically collect information when you visit them, such as but not limited to browser characteristics, operating system, settings, ISP, domain name, IP address, type of computer or mobile device, mobile carrier, connection information, and unique device identifier.
Your Activity: We may collect information about how you use our Service(s), such as the types of content you view or engage with; the features you use; the actions you take; the people or accounts you interact with; and the time, frequency and duration of your activities. We use this information for a variety of purposes, including to tailor the Service(s) to your preferences and otherwise improve your experience, to operate and administer the Service(s), to conduct research and analytics, to assess your interest in the Service(s), to deliver advertisements that may interest you, and to keep the Services secure.
6. How we use your Personal Data
User's data that is provided to The Wedding Wizard through any means so that it can render the service(s) required by them are collected for the following purposes:
Enable Users to rapidly and easily search for Suppliers that provide the services and products related to the wedding event by activity sector, type of service and location;
Advertise the services and products of Wedding Suppliers by creating a data sheet with their contact details, location, service and/or product description and photographs, where applicable;
Facilitate contact between the Suppliers which advertise their products or services on the Website and the users interested in them via information requests through emails, forms and telephone calls;
Enable Users to create a personal data sheet that can be accessed by the other Website users. For example, certain personal information (names, wedding date, etc.) is shared with your suppliers when you mark them as hired on the Website ;
Provide Users with all the information required to hold a wedding through articles and advice published on the Website;
Provide Users with wedding planning assistance, through the use of our planning tools;
Create a Website community for participation so that all the Users, whether or not they are registered, can access it;
Maintain regular and dynamic communication with the Users through any means, including social media and instant messaging.
The Wedding Wizard is legitimised to process the Users' data with the aforementioned purposes so that it can comply with its contractual obligations as a result of the requests made by Users.
The Users' data provided to The Wedding Wizard through any means shall also be collected with the following purposes:
Analyse the data for training and/or statistical purposes. Carry out the basic activities to analyse the content of the information provided and draft the profiles to appropriately manage the activities and services provided by The Wedding Wizard;
Send electronic communications of the promotions and information about services provided by Suppliers and/or The Wedding Wizard related to weddings, and to the needs or interests that the engaged couple, their guests and suppliers may have during the wedding organisation process given the nature and purpose of the services provided by The Wedding Wizard. For such purpose, it is understood that the wedding products or services are all the products and services included on the Website at present and in the future as well as any products, services or campaigns specifically aimed at weddings;
Such promotional electronic communications shall be sent throughout the relationship between the Users and The Wedding Wizard and even after it has ended, provided that the Users have not stated otherwise. Users can request this can change or delete such services by following the instructions stated at the bottom of the electronic communications.
The Wedding Wizard is legitimised to process the Users' data with the aforementioned purposes, as expressly acknowledged in the legislation in force, (i) in the event that the Users gave their consent and/or (ii) in the event that the information is about products and services similar to those addressed by a previous sale or negotiation, provided that the Users did not decide to stop receiving such communications.
7. Automated Decisions
The Wedding Wizard shall not adopt decisions which may affect the Users based only on the automated processing of their personal data. All the decision-making processes related to the aforementioned purposes of the processing are carried out with human involvement.
8. Emails – Opting out
We strive to provide you with choices regarding certain personal data uses, particularly around the emails you receive from us. If you are a subscriber, you will also receive marketing communications from us if you have requested information from us or created an account with us and, you have not opted out of receiving that marketing.
We will get your express opt-in consent before we share your personal data with any other company for marketing purposes. You can ask us or third parties to stop sending you marketing messages or reminder emails at any time by following the opt-out links on any marketing message sent to you or by contacting us at email@example.com at any time.
For the sake of transparency, you cannot 'opt-out' of transactional emails, which are sent to you to notify you of activity on your account on the Website. These are required to provide the service(s) to you.
“Cookies” are small data files stored on your computer or device to collect information about your use of the Service(s). Cookies may also be used to enhance your experience on the Site (for example, by storing your username) and/or to collect general usage and aggregated statistical information. Most browsers can be set to detect cookies and give you an opportunity to reject them, but refusing cookies may, in some cases, limit your use of the Website or its features.
9.1 We use the following Cookies
Strictly necessary cookies: These are cookies that are required for the operation of our website. They include, for example, cookies that enable you to log into secure areas of our website.
Analytical/performance cookies: They allow us to recognise and count the number of visitors and to see how visitors move around our website when they are using it. This helps us to improve the way our website works, for example, by ensuring that users are finding what they are looking for easily.
Functionality cookies: These are used to recognise you when you return to our website. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).
Targeting cookies: These cookies record your visit to our website, the pages you have visited and the links you have followed. We will use this information to make our website and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.
9.2 Disabling Cookies
You block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.
10. Disclosures of your personal data
We may need to share your personal data with the parties set out below:
Service providers acting as processors who provide IT support, IT backup, Marketing Support, Data storage, Email management and System administration services;
Analytics and advertising service providers for the purpose of analysing user behaviour & retargeting;
Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Notice;
Public authorities to comply with the legal obligations to which The Wedding Wizard is subject as a result of its activity.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
11. Data of minors
The website is not intended for children under 16 years old and we do not knowingly collect data relating to minors.
Users that provide personal data of minors and, in particular, their image to the Website expressly implies that, without reservation, the Users who provide them:
Hold the necessary rights to use the data or image of the minor ;
Ensure that the data does not jeopardise the minor in any way whatsoever or harm any of their rights;
Expressly exonerate The Wedding Wizard from any potential claims arising from this, where the Users assume that they provided the information with the full liabilities arising from such claims.
12. International transfers
We do not have service providers who will transfer your personal data outside of the EEA at present.
In the event we do engage service providers processing your personal data on our behalf with servers based outside the European Economic Area (EEA), i.e. which will involve a transfer of data outside the EEA, we will ensure a similar degree of protection is afforded to it by ensuring that either:
we have a specific contract with that processor in a form approved by the European Commission which ensures that service provider gives your personal data the same protection it has in Europe; or
confirm that the provider is based in a jurisdiction which requires them to provide similar protection that we have here in Europe to personal data.
13. Data security
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
13.1 How long will we use your personal data for
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances, we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
14. Your legal rights
You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:
the right to access your personal data;
the right to request the rectification and/or erasure of your personal data;
the right to restrict the use of your personal data;
the right to object to the processing of your personal data;
the right to receive your personal data, which you have provided to us, in a structured, commonly used and machine-readable format or to require us to transmit that data to another controller (data portability); and
where our processing of your personal data is based on you having provided consent, the right to withdraw your consent to the processing at any time.
15. Responding to requests
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
